WV Couple Files Mesothelioma Claim against 70 Companies
A couple has filed a mesothelioma claim against 70 businesses they allege are liable for a malignant mesothelioma diagnosis.
West Virginia resident John L Lafferty was diagnosed recently with mesothelioma, an incurable cancer affecting the mesothelial cells, the lawsuit filed in the Marshall County Circuit Court says.
John and his wife, Mrs. Dorothy Lafferty, allege that the only medically known reason for malignant mesothelioma is exposure to asbestos fibers. John Lafferty has suffered heavy asbestos exposure during his career while working at different job sites in W. Virginia as a supply person, the complaint says.
The defendants’ sale, manufacture, use, distribution, disturbance, specification, and installation of products containing asbestos exposed John to the cancer-causing mineral, the suit claims. As a result, he developed malignant mesothelioma, the plaintiffs say. John Lafferty was diagnosed with mesothelioma in August 2015, according to the suit.
The plaintiffs allege that inhalation of and exposure to asbestos fibers was the direct and proximate reason for John’s mesothelioma development. During his career, John worked with and was exposed to asbestos products and several other toxic minerals made, supplied, distributed, sold, specified, used , installed, required, or removed by the defendant companies, the lawsuit states.
The complaint states that the defendant companies failed to warn John of the hazards associated with their asbestos products. Additionally, the companies are accused of failing to take sufficient precautions to warn workers such as John of the hazards they were exposed to even though they were fully aware of the dangers.
The defendant companies negligently failed to exercise sufficient care to warn John and other workers of the hazards to which they were being exposed to by the use of asbestos products, the lawsuit claims. The defendants also failed to inform workers of what could be safe apparel for an individual who deals with asbestos-containing products, the plaintiffs allege.
The plaintiffs allege that the negligence of the defendants caused severe injuries and damages. Mesothelioma is an incurable disease and so John is now living with the fear of death, according to the plaintiffs.
In their lawsuit, John L Lafferty and his wife are seeking unspecified compensatory damages, in addition to costs, pre-judgment interest, post-judgment interest and punitive damages.
