Widow of Lung Cancer Victim Files Asbestos Claim

A woman is suing more than 40 companies, alleging that they exposed her deceased husband to asbestos.

Bethi Dates says her husband Roosevelt Dates died after developing asbestos-related lung cancer because of his continuous exposure to the defendants’ asbestos products. Bethi, as the independent administratrix of Roosevelt’s estate, has filed a suit on October 27 in the St. Clair County Circuit Court. Bethi names more than 40 companies as defendants, including: CBS Corp; Union Carbide Corp; American Standard Incorporated; Metropolitan Life Insurance Co; and Union Pacific Railroad Co.

The complaint states that Roosevelt started working in the 1950s and continued until 1992. During this time, he worked with and around many asbestos-containing products of the defendants and inhaled or ingested large amounts of hazardous fibers emanating from them.

Because of heavy exposure to asbestos fibers, Roosevelt developed asbestos-induced lung cancer, the lawsuit states. He was diagnosed with cancer on 28th April, 2015, according to the lawsuit. Roosevelt died from his disease on October 18, 2014, the lawsuit states.

Prior to his death, Roosevelt had to pay large amounts of money for medical treatment, the suit states. Additionally, he experienced extreme physical pain and emotional anguish, the plaintiff alleges. Roosevelt was also prevented from pursuing the normal course of his employment and thus lost large sums of money that would have accrued to him, the complaint states.

Bethi Dates argues that her family was deprived of Roosevelt’s support and lost his society. Additionally, the estate had to spend significant amounts of money in funeral and burial costs, according to the suit.

Metropolitan Life Insurance (Met Life) is accused of conspiracy. The plaintiff alleges that the insurance firm conspired to terminate experiments and researches on the hazards of asbestos. According to the suit, Met Life keenly suppressed publication of articles on asbestosis in a public magazine.

Bethi Dates is seeking in excess of $50,000 from each defendant.
