VA Couple Sues Companies over Mesothelioma

Charleston, West Virginia – A couple from Highland Springs (Virginia) has filed a lawsuit against 143 companies over allegation that they are legally responsible for a mesothelioma diagnosis.

On 8th March, Edward Comer was diagnosed by his doctors with malignant mesothelioma, the suit filed in the Kanawha County Circuit Court in Charleston, WV, says. According to Comer, he had been a smoker until year 1986. He says he completely stopped the habit of smoking in 1986.

The companies are being sued based upon the theories of: violation of implied and express warranty; negligence; strict liability; contaminated buildings; intentional tort; post-sale duty to warn; misrepresentation; and conspiracy.

Comer says he had been exposed to hazardous asbestos fibers during his job. Comer worked as an insulator between 1960 and 1984, according to the suit. Comer, along with his life partner Barbara Comer, is asking for a jury trial in order to resolve the issues involved in their complaint. The case is being presided over by a visiting judge.
