Charleston, West Virginia – A Collinsville (VA) couple is suing 137 defendant companies they allege are liable for a malignant mesothelioma diagnosis.
Larry I Nolen, along with his wife Annie Nolen, has filed a suit against the companies in the Kanawha County Circuit Court. According to the suit, Larry Nolen is suffering from malignant mesothelioma which he contracted as a result of his job-related asbestos exposure.
The couple says Mr. Nolen smoked cigarettes between 1960 and 1989. Larry Nolen was an employee of the defendants from 1960 until the 1980s. The Virginia resident also worked as a pipefitter from 1950 until 1960, according to the complaint.
Nolen alleges that the defendant companies caused him to contract mesothelioma as they negligently failed to protect him from hazards and warn of the risks involved in his job. The companies are sued upon theories of: contaminated buildings; violation of express warranty; violation of implied warranty; negligence; strict liability; conspiracy; intentional tort; post-sale duty to warn; and fraudulent misrepresentation.
The plaintiffs say the defendants are responsible for Mr. Nolen’s mesothelioma. In their suit, the couple is demanding a jury trial for resolving all the involved issues. The case is being presided over by a visiting judge.
