Charleston, West Virginia – A Coal Grove (OH) couple has filed a suit against 62 defendant corporations over allegations that they are liable for the man’s mesothelioma diagnosis.
Larry Shelton and his wife Barbara Shelton have filed a lawsuit against the companies in the Kanawha County Circuit Court in West Virginia.
Larry Shelton says he suffered asbestos exposure all through his employment as a laborer, roofer, and bricklayer between 1964 and 1993. He says the defendants were aware of or should’ve known of the hazards of exposure to asbestos particles, the lawsuit claims. But they failed to warn Larry Shelton of those hazards, the complaint states. The defendants sent Larry Shelton to work near hazardous asbestos-containing products without providing him adequate safety apparel and warning him of the known risks, the plaintiffs claim.
The plaintiffs are suing based on the theories of: violation of expressed and implied warranties; negligence; strict liability; contaminated buildings; conspiracy; negligent misrepresentations; intentional tort; post sale duty to warn; and fraudulent concealment.
Larry Shelton and Barbara Shelton are seeking unspecified damages. They are requesting for a jury trial for resolving the issues. A visiting judge is presiding over this case.
