Charleston, West Virginia – A Charleston man is suing numerous corporations he alleges are liable for the lung injury that took the life of his father.
Steven Westfall, the son of deceased Larry Westfall, has filed a suit against 199 companies in the Kanawha County Circuit Court. The suit says Larry Westfall had been a member of the Laborers Local Union Number 639. Additionally, he had worked all through the West Virginia and other parts of the country and handled many asbestos products, the complaint claims.
According to Steven Westfall, his father died after developing asbestosis and malignant mesothelioma. Both these diseases are linked to long-term exposure to asbestos fibers.
Steven says the defendant companies negligently failed to exercise sufficient care to warn his father of the hazards to which he was being exposed on a regular basis while working with and near their asbestos products. The companies failed to warn the plaintiff’s father of what could be safe apparel for an individual who was working with and around asbestos products, the lawsuit claims.
The defendant companies also failed to advise Larry of what could be proper and safe methods of dealing with and working around asbestos products, the lawsuit claims.
In his lawsuit, Steven Westfall seeks unspecified compensatory damages. He is also seeking punitive damages. A visiting judge is presiding over the case.
